Net30 Terms and Conditions
Terms & Conditions – Wholesale Orders (Net 30)
1. Payment Terms
By choosing Net 30 at checkout, Buyer agrees to pay the full invoice within thirty (30) calendar days from the invoice date.

Net 30 credit is extended solely at the discretion of Clear Water Distilling Co. (“Seller”).

Seller reserves the right to revoke Net 30 terms at any time.

Any unpaid balance after thirty (30) days will accrue interest at 1.5% per month (18% annually) or the maximum amount allowed under Colorado law, whichever is less.

Buyer is responsible for all attorney’s fees, court costs, and collection expenses incurred by Seller to recover unpaid amounts.
2. Order Confirmation
Before an order can be submitted, Buyer must acknowledge and confirm acceptance of these Terms & Conditions.
At checkout, the following statement will appear:
By checking this box, Buyer confirms that they have read, understood, and agreed to Clear Water Distilling Co.’s Terms & Conditions, including Net 30 payment obligations, Colorado liquor law compliance, and liability for late payments. Buyer further represents and warrants that they hold a valid Colorado liquor license.
Orders will not be processed without this acknowledgment. Confirmation will serve as a binding agreement enforceable under Colorado law.
3. Licensing & Compliance

Buyer must hold a valid Colorado liquor license authorizing the purchase and resale of alcohol.

Seller will only deliver products to the licensed premises listed on Buyer’s liquor license.

A licensed representative 21 years of age or older must be present to accept delivery.

All sales are subject to the Colorado Liquor Code and regulations enforced by the Colorado Department of Revenue.
4. Returns & Refunds

All alcohol sales are final under Colorado law.

No returns or exchanges are accepted except in cases of defective or damaged product.

Claims of defect or damage must be reported within five (5) business days of delivery.
5. Risk of Loss & Title

Risk of loss passes to Buyer upon delivery to licensed premises.

Title shall transfer in accordance with Colorado statutes and applicable liquor regulations.
6. Force Majeure
Seller shall not be held responsible for delays or non-performance caused by events beyond its reasonable control, including but not limited to:

Acts of God
-
Governmental actions
-
Transportation interruptions
-
Labor disputes
-
Supplier shortages
7. Governing Law
This Agreement is governed by the laws of the State of Colorado.

Venue for disputes will lie exclusively in the courts of Colorado or, at Seller’s election, Utah County, Utah.
